But what should Vecchiotti have done, disappoint Meredith’s lawyer? So, she explained to him.
She explained that the recovered alleles, able to form two more profiles, were not all. She had just picked those to explain the concept in the report. But, in truth, she recovered more alleles, much more –so many that it would have been too long putting them in the report.
Indeed, Vecchiotti explained, “After examining just the first 4 markers (over 17) of the Y chromosome, there were already new alleles for forming at least 8 profiles”! So she didn’t really continue to find the all of them.
For the autosomic STRs, Vecchiotti explained, “There were so many alleles that even my own profile was a match in 9 markers!” (over 16).
“Your own profile, President, could likely be found in that DNA”, Vecchiotti told Hellmann.
And she probably didn’t mean accusing him of having killed Meredith…
If we then add that 4 of the 16 autosomic markers, as Vecchiotti explained, were wrongly attributed to Raffaele’s profile, we understand why the report had concluded that there wasn’t Raffaele’s DNA on the clasps.
We finally have full comprehension of it, and we owe it to Maresca’s perseverance.
STEFANONI’S SELF DEFENSE, DAY 1
Then it was the time of Stefanoni’s self-defense, under the friendly questions coming from Comodi.
Stefanoni explained to us why the certification doesn’t count too much. Only three labs in the world have the “ISO17120” certification, Stefanoni revealed, and for investigations on fire accidents (as a matter of fact that should mean that nobody in the world has the right certification..). You guys can verify it on the EMSI website. I trust her.
Also, the guidelines, according to Stefanoni, don’t really exist for the whole world. The ones cited by C&V are guidelines that every single institution issued, but there’s not a recognized international protocol, not yet.
She also revealed why you can put samples in plastic bags without that to cause problems: because you can store them in the victims freezer… That’s what she did on November 2 and 3, before bringing the samples to Rome: she froze the samples in the refrigerator of the house. That little freezer was quite capacious, it seems.
So, she could be the one putting down the international protocols. One of the rules would say: “make sure that there’s room in the victim’s freezer”, something like that. It implies also a recommendation for future victims :”Tell your murderer to only kill you near a working refrigerator”.
Apart from that, Stefanoni appeared very excited and anxious, almost breathless, about her self-defense. A bit hard to follow, especially if you are not familiar with the Neapolitan accent. But in the end, it was interesting as always. An interesting insight about DNA, I promise you.
She even showed two charts which should represent the negative/positive controls, and she inserted them in a detailed explanation of why Meredith’s alleles are, according to her, genuine. Hopefully Hellmann will acquire these by now famous controls, so that we can see if they have been done for sure.
Then the discussion got lost in picograms, nanograms, microliters and other minutiae. But the main point, for Carla Vecchiotti, remains the same: that those tests couldn’t be repeated, therefore they will never be certain, even if the negative and positive controls seem to have been done for real. You have to have faith in them, and that’s it.
Maresca also has a main point, and he keeps repeating it: there are other tests to be considered besides those two.
Indeed there is another test to be considered, a test that was never performed: those stains on the pillow. The real main evidence. Can you believe that they have been testing the shit, they have been testing the imagination, but they haven’t been testing the real MAIN EVIDENCE, the semen, the substance that every coroner looks for in case of rape! Only in Italy…
But let’s not blame Mignini’s investigation for that, let’s not “defame” it. Maybe there was a valid reason for not testing the main piece of evidence: maybe the refrigerator was full.
Curiously, we all want that test to be done, we all want to know who raped and killed Meredith, because we, who didn’t know her, love her in some way, and hope she has justice.
But her lawyer, her family, don’t look too interested!
Stefanoni’s examination will resume tomorrow. Then the private experts will take the stand.
Will they be able to explain to the prosecution that no matter how perfect (to say so) Stefanoni’s tests may have been, there would still be no certainty?

Frank, this is good stuff. Drama doesn’t get too much better than this. And I agree about your writing. The freezing thing is a scream. What is NOT a scream, however, is my concern about what you said about the Kercher family not seeming overly interested or concerned about testing the semen. This is hard to believe that they truly wouldn’t be dying to know. Is this really true????? If so, this needs to be talked about, dealt with. It makes me horribly sad that their attorney, who is all but satan himself, in my book, is the guy they put their trust in. Who knows how any of us would be reacting in their situation but this is beyond discouraging. I got grief just today for admitting frustration over such things…michellesings1.blogspot.com (I blogged about it a bit). Anyway, keep doing what you do do. Another great blog! This is where we come for insight. It seems the dog barfed up Stefanoni’s homework for her. This is something I’m really disturbed seeing. Why is she allowed to get away with this? She didn’t turn over the all the files at the first trial, she caused a jail worthy obstruction of justice by delaying giving the independent experts the data they required and now this continued control data drama. How many versions has she given on that now? A few nights in jail for obstructing justice should be given. Does anyone else find it CREEPY that she stored bloody objects in the cottage freezer? I suspect she is straight lying about the freezer.

That semen stain should have been the first thing tested! It’s absolutely outrageous that it hasn’t been. Stefanoni was in charge of the evidence collection and she was criminally incompetent. She didn’t test the semen stain, she didn’t have the Meredith Kercher’s clothing that was removed from her in the struggle picked up off of the floor, she gift wrapped a mop ………
She was part of a team, it seems. And that’s not scientific…

A few questions.
1. When Comodi tried to enter the “newly found” neutral controls did the defenders jump up to protest?
After all… these new findings prove what the defence has been saying all along ….that the prosecution was witholding DNA evidence from them. If these negative controls are not found in the trial records in the first instance then doesnt that make that trial invalid. It proves that the prosecution withheld evidence crutial to the defence. It proves that the prosecutor broke Italian law by not protecting and providing evidence that could help the defence..Comodi speaks about if the Independant experts wanted this all they had to do was ask…but what about during the last trial when the defence ask for ALL the records including the electronic data files. Its being reported here that these files were found in a garage.
2. What do you make of the sisters letter and the timing of it to match the reopening of the court session? How is it being reported in the Italian press? The blogs here see it for what it is. A trick from Maresca to focus attention away from the weak case and onto sympathy for Merediths family. I personally think the family is being used and the timing of these letters and articles make me think they dont care about truth…now they care about the money. SO sad.
3. Why do you think the sister would write a letter to her lawyer about the prosecutions case anyway?
4. When will someone in Italy finally say ENOUGH! How much more is the Italian justice system willing to be made a mockery of? Do the judges have any power to take action against lies of prosecution and police? At the last hearing Hellmann told Comodi …no matter if you have the negative controls and they are properly entered into court it still DOES NOT disprove contamination. Now she brings up the matter again and Hellmann seems to backpedal and he says he will decide the matter later. DId he forget the last hearing? Or is he being clever? I would have reminded Comodi of our last little talk…whats up with Hellmann?
5. Did the defence object to the netural data being entered for any particular reason ? I mean did they state a reason such as…we object to this data because it was denied to us in the last trial and therefore we move to have this case thrown out due to malfeasence by the prosecution and for misleading the court by withholding important evidence? That type of objection???

If you will indulge me, I have a question related to the randy2438 question 4….I’m trying to get an idea of who Magnini, Comodi, and Stefanoni report to in their respective organizations. Are any of these people elected to their position or are they all appointed? Have there ever been any leaks about their job performance in this case? Is anybody about to get the dreaded “vote of confidence”?
They are just hired form the state after having won a contest. Once you are in, you get that job, and that salary, for all your lifelong . It’s the problem of people working for the state. Once they are in they don’t have to compete anymore. That’s why they often become unable to work and reason in a decent way…
What makes me nervous, is this public letter to the court by Stephanie.
Thereupon, I’ve tried to count 1 and 1 together.
Stephanie gave the court an open letter in which asks you to check every piece of evidence.
Maresca then seems not to be tired to repeat continually that there is yet more evidence.
This leads me to believe that Marescas team in the corner standing, pursuing a last nasty trick.
My gut feeling tells me that this letter (in particular the content) was slightly deflected.
Someone certainly had no great difficulty to convince Stephanie that it is now once again it would be important to set a sign. “In memory of Meredith”
The mourning of Kercher is of course still very great.

I feel very badly for her too. She is being lied to. she is a stunningly beautiful young lady. She looks soooo much like what once was her younger sister. I wish only that they knew we ARE on their side. We fought FOR them, not against them, in our search for truth.

I just noticed the expression on Stefanoni’s face. She looks like she’s literally in fear for her life… and contemplating how and when she’ll have the chance to bolt the courtroom. If this is the kind of image the prosecution will be presenting in their own appeal, then Amanda and Raffaele have nothing to worry about… assuming they don’t have another Massei on their hands, that is.
