That Forgotten Telepic

Monday afternoon, a hearing for the Hayden Panettiere TV-movie took place in Perugia’s civil court. Lifetime was a no-show, and nothing happened. The trial is postponed to some future date, at a time when nobody will remember that old inaccurate TV movie, which will be just one line in the long diary of this unbelievable affair.

The ‘Defamation’ Trial

In the morning, another trial started (it tried to start) against two other ‘dangerous criminals’, namely Edda Mellas and Curt Knox. They are accused of defamation for having said that Amanda said that she was slapped in her head. (I should be tried too, since I’m saying that they said that she said it)

Judge Paolo Micheli declared himself incompatible and returned the file to the court, which will assign it to another judge. The date is reappointed to January 24, 2012, for those who will be in Perugia (certainly not Curt and Edda…).

A judge who feels he can be influenced by something, indeed, has the right to step down from a case. And Micheli felt he could be influenced by the fact that he had previously judged their daughter in the pre-trial phase.

The ‘Slander’ Trial

However, when it’s the defendant who thinks the judge may be influenced by something, it may not be as easy to get a judge to step down. Indeed, we remember the impressive ‘slander case” against Amanda. Judge Claudia Matteini, who had already acted on the Knox case during the investigation, refused to step down from the trial, even if explicitly requested to do so by Knox’s defense.

Why did Micheli go away so easily and Matteini, instead, absolutely want to stay in charge? Why did Matteini fight so much to stay in the proceedings when it results in her work load increasing?
It’s a matter of temperament, probably.

Different Styles

Matteini, Micheli and all the others believed the absurdities that the cops told them about Amanda and Raffaele. Why? Because their culture and education are the same and they learned at school that the word of the police can’t be doubted! (even if, as we have seen, no law says that). But everyone acts according to their own individual style and temperament. There are those who take it personally, and feel hatred, and believe they never have to leave the person alone.

What about relaxing, instead, and enjoying life?

‘INVESTIGATIVE ACUMEN’ *

I always thought there was a zero chance that Amanda and Raffaele would be ultimately condemned. In the end, indeed, there’s the Supreme Court, and the Supreme Court certainly can’t send you to jail for 26 years because of two pieces of paper on which someone wrote that there was some DNA on a knife and some other DNA on a bra clasp… (now we know that there are not even those two pieces of paper anymore, so…).

But THEY… They were not looking that far away. They never look beyond the immediate day.

They arrested Patrick Lumumba, Amanda Knox and Raffaele Sollecito without any evidence, and their intelligence made them think the case was CLOSED: they were happy, they were celebrating!

The day Amanda and Raffaele got condemned, there was no one slightly fearing that the damage they caused was going to be bigger. No, they were happy, they were celebrating again!

‘HIGH PROFESSIONAL SKILLS’ *

After having signed this whole masterpiece, they even pressed for compensation from Amanda Knox, because she had ‘slandered’ them! (Mignini and Comodi, indeed, had sued Amanda on behalf of the police because she explained how she ended up signing that Lumumba had killed Meredith. And you can’t explain. You can’t defend yourself. You have to ask to be condemned.)

Then, they made another bold move, and sued her parents for having repeated to the English press what she said!
And now they are wanting money even from her parents. And two more trials have begun to resolve these developments.

It’s not all. A trial has also been set against the Sollecito family; there are a slew of trials directed against journalists; and they even managed to sue a guy for the ‘crime’ of having brought a picture to Amanda’s family!

Are you thinking that someone should stop these people? Maybe you are not the only one.

Trials in a series, and for no reason: it’s THEIR way to ‘help’ the judicial system, which is already sinking under too many proceedings (in the words of the President of the Supreme Court and, locally, of the President of the Court of Appeals of Perugia).

But who exactly are these people? You can’t find their names anywhere? Better taking note of them, then.

-Victims of Amanda Knox who want to be compensated by her:
Edgardo Giobbi, Marco Chiacchiera, Monica Napoleoni, Rita Ficarra, Lorena Zugarini, Ivano Raffo, Favio Facchini, Fabio D’Astolto, Luca Scatigno. They involved even the interpreters:, Anna Donnino, Aida Colantone (who wasn’t there that night) and Marco Bellanca (who never entered the police station…).

-Those who want to be compensated by Curt Knox and Edda Mellas:
Monica Napoleoni, Rita Ficarra, Lorena Zugarini, Stefano Gubbiotti.

-Heroes who accepted an award for having arrested –thanks to their ‘high professional skills”– Patrick Lumumba, Amanda Knox and Raffaele Sollecito (!);
for having understood –thanks to their ‘investigative acumen’– that Amanda and Raffaele had called the 112 after the postal police arrived (sure…);
for having provided –‘with uncommon operative determination’– the knife with the DNA of Meredith on it and the bra clasp with the DNA of Raffaele Sollecito (ended up the way we know):
Marco Chiacchiera, Monica Napoleoni, Rita Ficarra, Lorena Zugarini, Stefano Gubbiotti, Stefano Buratti, Stefano Sisani, Andrea Cardaioli, Davide Dominici, Mirko Gregori, Armando Finzi, Raimondo Marcacci, Luigi Pochini, Giuseppe Migliaccio, Massimo Ricci, Rico Rolli.

I guess these are all the ones who had the PRIVILEGE of appearing in the unforgettable picture of November 6, almost all the 36 who had the HONOR of signing Mignini’s order of arrest of Patrick Lumumba, Amanda Knox and Raffaele Sollecito…
Because yes, everyone wanted to sign the trophy! (Of course, the case was closed!)

They had the brilliant idea to pose for cameras, celebrate publicly, accept awards, ask for compensations, give their signatures…
Luckily, so we know, now, who Italians have to thank for all these trials and all these days in jail.

    I don’t believe Amanda ever named which officers slapped her, so these Keystone Kops are basically admitting they did slap her with this lawsuit. Amanda makes the claim and these goofs jump up and say “She must be talking about me!”.

    What is truly amazing about these heroes is that when it came time to find the real killer named Rudy Guede the police get the credit for this but that is simply not true and undeserved.. They had footprints, hand prints, DNA, they had knowledge of a small time burglar who tossed rocks thru second story windows and climbed in. Is this how the pack finally got Rudy? NO! If left on their own the Perugia police would still be wondering who done it. Rudy’s friend went to the police and told them that he suspected his friend named Rudy Guede was maybe involved in this murder. He figured it out by speaking to or emailing Rudy. Later the police had this friend make a tapped skype call, but before that this friend had solved the crime.

    And Mignini? He was pondering satanic orgy’s and cartwheels. I wonder why he only ever files charges against Amanda? Would it be too much to expect him to file charges against the police for striking her? Or lying to her about a lawyer during her interrogation? Or file charges against police for not protecting evidence helpful for her defense (like interrogation tapes) all these things are his legal duty to perform. Perhaps some prosecutor needs to file charges against Mignini for failing to do his job for the defendant….you know her…Lucerfenia the cartwheeling satanic sex killer. They say you can see it in her eyes…..

    Great post. Thanks for naming names. There should be some acknowledgement on who made this all happen. Unbelievable that 36! of these clowns signed the arrest warrant. Why is Stefano Gubbiotti suing Amanda’s parents but not Amanda? That’s strange, no? I would like it they were all brought up on charges; in reality not likely any of them will suffer much. That seems to be the way these things go. Innocent people can waste years of their lives and no one pays for the mistake of taking their years away. It is wrong. There should be someone to pay the price for this. In the USA the supreme court recently ruled that a man who spent years wrongfully convicted did not have to be given ANY compensation. I think that is a crime. A persons life is all they really have, to take that away deserves great compensation. I think Stefanoni and Mignini are the most likely to come out of this poorly. Stefanoni’s reputation will be ruined, deservedly so. Sorry, Frank, no sympathies for this chick from me. She was FULLY involved and complicit. Mignini I hope will have his abuse of office charges confirmed. He needs to be removed from office. He is an absolute menace to society. The pack? You would think they would at least have to return their merit awards !!!

    I wonder if this “bullying” approach is working for the prosecutors? From the crime tourist sections it appears very obvious the “bullying” by the prosecutors is a legal game play, but how does it to the locals (jurors)?

    And after all Amanda and parents only said one person stood behind her not all of them.

    So if I say Mignini punched me on TV…..he can sue. But how can the entire “clan” sue, when I didnt state they all punched me?

    In other words can I add my name to some list for compensation too? I could use some Starbucks money.

    EXCELLENT post! I hope (other) journalists are paying attention to the ‘uncommon professional determination.’

    Randy2438 made an additional great point about how — despite all that professional zeal — the crime was solved by the intervention of Rudy’s friend.

    People talk about heads rolling… No doubt that would be in Perugia’s best interest. But I’m not counting on it. I think the gang will protect its own… I reckon they’re pretty good at that.

    Thanks for the post Frank. Can you tell us what has happened with Lumumba and statement he made against the Perugia police that arrested him?

    Also, can you tell us what evidence exactly the prosecution is holding against Amanda and Raffaele? Everyone mentions that this case rests upon much more in terms of proof of their guilt, but it is never mentioned what it is.

    What was Edgardo Giobbi a victim of? Wasn’t he down the hallway in a room, and not even in the interrogation event?

    Edgardo was the one who heard screaming if I recall, while one said there was no screaming. This is documented from Judge Masseis trial records?

    With budget crunches so bad MIgnini said on film, the reason no one could even record the interrogation. Edgardo was there though, he probably paid for his own gasoline.

    Edgardo is a main character once he was found being interviewed on video and saying how he didn’t need science to know who was guilty, he can just tell. (someone has a better budget for recording obviously)

    Its probably why Edgardo, oddly, put Amanda’s picture up on the police wall before the trials are over too.

    to be defamed, ridiculed, accused…. and Edgardo wasn’t even in the same room. How powerful is this college girl?

    Nothing happened for Lumunba’s statements. They didn’t sue him, they didn’t sue the Daily Mail.
    They don’t have to destroy Lumumba, they have to destroy Amanda.

    What is the prosecution holding?
    The footprint on the bathmat that they dream is Raffaele’s. The mixed DNA in Filomena’s room with Meredith profile and maybe Amanda’s…
    The mixed DNA Meredith-Amanda in the toilet that they dream it’s crime related…
    The luminol footprints that they dream they are crime related.
    The prosciutto slicer who was already disproved at the first trial.

    That’s what remains, only dreams….

    Why so quiet? We dont understand any Italian. A few here are trying to translate the expert report. Why dont you write about it. You can digest it down so we can understand.

    In particular the issue of the Y haplotype on the bra clasp still seems sound even in the expert report. Is this true?

    How did the judge allow Mignini (why is he even still in this case?) to read a statement that RG did not even understand all the words he had written? Did the judge ask Rudy is he understood all the words or is that a lie?

    Much we dont know Frank…perhaps since you understand both language it seems apparent to you but we have lots of unanswered questions.

    Why did the judge fail to ask RG about his role in the murder? Rudy wrote a statement that the marvolous girl Meredith was killed by RS and AK. Is the judge stupid? Cant he ask about this statement? Cant the defense lawyers ask?

    And finally Maresca. This piece of shit needs a whole article by you. He does a disservice to the Kerchers, to the court and to the defendants. This clown makes a mockery of Italian justice. Maresca can say the jail bird sex change witness seems reliable??? And he gets away with that?

    The prosecution will have to leave Amanda outside Merediths room.

    That much is over with the recent findings of the knife. Its no blood and its not a cleaned, how much simpler can it be?

    I suppose Maresca can still scream ignorant things from the tourist section and wave photographs from 10 yrs ago…I think Miginini is pressuring him to yell.

    Way to add insult to injury. If anyone should be seeking compensation it is Amanda and Raffaele from the jackasses who threw them into prison in the first place. They have alot to sue for, too.
